As our customer you provide us with important
Information about yourself. We believe it is our
responsibility to safeguard your personal and
financial information, and we recognize and
respect the privacy and security expectations
of our customers. We are committed to keeping
your personal and financial information confidential
and will share it only as described in this Policy or
as allowed by law.
This Privacy Policy describes how we collect and
use your personal information and how we
maintain the confidentiality and accuracy of such
information. This disclosure applies to our former
customers as well as existing customers.
NOTICE OF YOUR FINANCIAL
PRIVACY RIGHTS
We, our, and us, when used in this notice, mean
Bartow County Bank.
This is our privacy notice for our customers. When
we use the words “you” and “your” we mean the
following types of customers:
• Our consumer customers who have a
continuing relationship by purchasing or
holding financial products or services
such as a(n):
• Deposit account
• Loan account
• Safe deposit box
• Self-directed Individual Retirement Account
We will tell you the sources of the information we
collect about you. We will tell you what measures we
take to secure that information.
We first define some terms:
Nonpublic personal information means financial
information that relates specifically to you and that
is not available from a public source (such as
government records, phone books, or widely
distributed media). For example, the fact that you
have a deposit account with us and the balance
of that account, is nonpublic personal information.
In contrast, the fact that you have a mortgage
loan with us would not be nonpublic personal
information if your loan is secured by property
that is located in any county or state where
mortgage loans are recorded in government
records.
An affiliate is a company we own or control, a
company that owns or controls us or a company
that is owned or controlled by the same company
that owns or controls us. Ownership does not
mean complete ownership, but means owning
enough to have control.
A nonaffiliated third party is a person we do not
employ or a company that is not an affiliate of ours.
This is also known as nonaffiliated third party, or
simply, an “other party.”
THE INFORMATION WE COLLECT
We collect and maintain various types of information
about our customers, including:
- Identifying information, such as social security
numbers, driver’s license numbers, account
numbers, names, addresses, and personal
identification numbers (PIN’s) and passwords.
- Information regarding your creditworthiness
and capacity, such as employment status,
income, and information on your assets and
liabilities that you provide to us in your
applications.
- Account activity information, such as deposit
balances, loan balances and transaction
histories with us.
- Information about your transactions and
experiences with us, such as your payment
or overdraft history.
THE CONFIDENTIALITY, SECURITY, AND
INTEGRITY OF YOUR INFORMATION
We restrict access to information about you to those
employees who need to know that information to
provide products or services to you. We maintain
physical, electronic, and procedural safeguards to
protect this information.
YOUR INFORMATION AND OTHER PARTIES
We will not disclose information about you to anyone
except as disclosed in this policy or as permitted by
law. Examples of this might include disclosures
necessary to service your account or prevent
unauthorized transactions.
Disclosures to Nonaffiliated Third Parties. We may
disclose information about you, including nonpublic
personal information, to nonaffiliated third parties
(persons who are not our affiliates) as described below.
You do not have the right to opt out of this sharing of
information.
- Disclosure to service providers. We may
disclose all of the information we collect, as
described above to companies that provide
services for us, such as ATM providers,
printing companies, check printers, loan
processors or servicers, and mail processing
companies. We require that these service
providers maintain the confidentiality of your
information and that they use the information
only for the purposes for which we have
provided it.
- Disclosure for marketing purposes. We may
disclose all of the information we collect, as
described above, to companies that perform
marketing services on our behalf.
- Additional marketing disclosures. We also
may share the following information about you
with financial institutions with whom we have
joint marketing agreements:
- Your name, age, address, and telephone number;
Information about your transactions and
experiences with us;
Information on your types of accounts with us; and
Information on your deposit and loan balances with us.
- We share this information so that we and these other companies
with whom we have joint marketing agreements can provide
you with information about additional products and services.
We require that these financial institutions maintain the
confidentiality of your information and that they use the
information only for the purposes for which we have provided it.
“Financial institutions” include banks, savings associations,
other lenders, insurance agents and companies, securities
broker-dealers, and other companies providing financial
products or services.
- Disclosure for legal requirements. We may use all of the
information we collect, as described above, to satisfy legal
requirements. For example, we will use your social
security number for income tax reporting purposes. We
also will share your nonpublic personal information with
government agencies and legitimate investigators as
required or allowed by law, including in order to comply
with applicable government reporting or legal process
(such as court orders, subpoenas, or government requests)
which we reasonably believe to be valid or required.
- Disclosure to consumer reporting (credit reporting)
agencies. We may disclose information relating to our
transactions or experiences with you to consumer reporting
agencies and similar organizations.
- Disclosure with your consent. We may disclose the
information that we collect, as described above, to any
person when you have provided your written consent
for us to do so, including when you give someone a
power of attorney or other authorization to act on your
behalf.
- Disclosure to joint applicants, guarantors and joint
accountholders. We may disclose information about
your loans or accounts with us, and your transactions
or payments with respect to such loans or accounts, to
persons who jointly own such accounts or who are your
co-borrowers or guarantors. We also may disclose
information concerning your credit history to persons
who are co-applicants with you, but only if we find it
necessary to decline your application or to later take
an adverse action with respect to your loan or account.
- Account numbers, PIN's, access codes. In no event
will we share your account numbers, PIN’s or similar
access codes to third parties for any marketing purposes
without your authorization.
